1. Acceptance of Terms

By downloading, installing, or using Etch ("the App"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

2. Description of Service

Etch is a keyboard-first productivity application for Windows that allows you to capture todos and memos quickly via a global hotkey. The App offers a Free plan and a Pro plan with expanded limits and cloud sync.

3. Account Registration

You may use Etch without an account on the Free plan. To access Pro features, you must sign in with a Google account via our website (etch.day). You are responsible for maintaining the confidentiality of your account.

4. Subscription & Billing

Pro subscriptions are billed monthly ($4.99/month) or annually ($47.99/year) through Polar.sh, our payment processor. Subscriptions automatically renew until cancelled. You may cancel at any time through your dashboard at etch.day/dashboard. Refunds are handled on a case-by-case basis — contact us at the email below.

5. Free Plan Limits

The Free plan is limited to 200 todos, 50 memos, and 5 categories. Cloud sync is available on all plans. We reserve the right to modify these limits with reasonable notice.

6. Acceptable Use

You agree not to misuse the App. Prohibited activities include attempting to reverse-engineer the App, accessing other users' data, or using the App in any way that violates applicable laws.

7. Intellectual Property

Etch and all related content are owned by the developer. You are granted a limited, non-exclusive, non-transferable license to use the App for personal or professional productivity purposes.

8. Disclaimer of Warranties

The App is provided "as is" without warranty of any kind. We do not guarantee uninterrupted service or that the App will be error-free. Use the App at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including loss of data.

10. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or in-app notice.
